Slack, et al. v. OS Restaurant Services, LLC d/b/a Carrabba's Italian Grill

Barkan Meizlish DeRose Cox LLP filed a lawsuit against OS Restaurant Services, LLC (Carrabba's Italian Grill) in the Southern District of Ohio, case number 2:26-cv-00040-JLG-EPD, before the Honorable Judge Graham. Plaintiffs allege that Carrabba's policies and practices violated the Fair Labor Standards Act and the Ohio Wage Acts. Specifically, Carrabba's maintained policies requiring bartenders and servers to share tips they earned during their shift with their managers and server assistants who did not work during the tipped employee's shift. The lawsuit also claims that Carrabba's required bartenders and servers to spend time prior to, after, and throughout their shifts performing non-tipped work such as rolling silverware, restocking, and cleaning their workstations while being paid at a rate less than minimum wage. The plaintiffs seek to recover lost wages, liquidated damages and attorneys' fees on behalf of themselves and all other affected employees who worked for Carrabba's within the last three (3) years.
