Fuller-Layton v. Stake Center Locating LLC
Barkan Meizlish DeRose Cox, LLP and Anderson Alexander, PLLC have filed a federal class and collective action on behalf of hourly Utility Locators and Lead Utility Locators employed by Stake Center Locating, LLC, one of the largest utility locating companies in the U.S. The lawsuit—filed in the U.S. District Court for the Southern District of Ohio under case no. 2:25-cv-01080-SDM-EPD—alleges that Stake Center violated the Fair Labor Standards Act (FLSA) and Ohio wage laws by failing to pay employees for:
- Pre-shift and post-shift work (such as logging into company systems, and completing reports)
- On-call duties performed off the clock
- Work performed during unpaid meal breaks
- Overtime at the correct rate, by excluding vehicle and per diem payments from calculations
The plaintiffs are pursuing unpaid wages, overtime, damages, and attorneys' fees on behalf of themselves and other affected employees across Ohio.
